The Honourable Graham Letto, Minister of Municipal Affairs and Environment, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.

UNDERTAKINGS REGISTERED:

Labrador City Microbrewery and Taproom (Reg. 1993)
Proponent: Iron Rock Brewing Company Ltd.

The proponent is planning to install and operate a microbrewery and tap room within the existing Bruno Plaza in Labrador City. The brewery will consist of a seven-barrel (840 litre) turn-key brewhouse with three fermentation vessels and one brite beer tank. Maximum annual production of this system in year one is estimated to be 660 barrels (79,200 litres). The beer will be sold in various portion sizes within the taproom, and will be available in growlers for off-site consumption. The brewery will also seek to distribute kegs to local establishments in the Labrador region as demand allows. The brewery intends to operate year-round.

The undertaking was registered on December 19, 2018; the deadline for public comments is January 24, 2019; and the minister’s decision is due by February 2, 2019.

Mount Pearl Cannabis Production Facility (Reg.1994)
Proponent: Atlantic Cultivation Ltd.

The proponent proposes to develop and operate a 10,200 square metre licensed cannabis production facility at 138 Clyde Ave, Donovans Industrial Park, Mount Pearl. The project will include construction of a two-storey steel structure to house the cultivation of cannabis plants. The building includes 31 grow rooms as well as processing rooms and office space.

The undertaking was registered on December 19, 2018; the deadline for public comments is January 24, 2019; and the minister’s decision is due by February 2, 2019.

ENVIRONMENTAL PREVIEW REPORT GUIDELINES ISSUED:

Glenburnie Drydock (Reg.1962)
Proponent: 3T’s Limited

The minister has approved the final guidelines for the preparation of the environmental preview report (EPR) for the Glenburnie Drydock. The EPR guidelines identify the information that the proponent will be required to include in the EPR. UNDERTAKINGS RELEASED:

Port Blandford Marina Development (Reg.1987)
Proponent: DFO, Small Craft Harbours Branch

The project is released subject to the following conditions:

  1. A complete application shall be submitted to the Crown Lands Eastern Regional Lands Office, and no project construction shall take place until a Crown title to the proposed site has been issued.
  2. A minimum 800-metre vegetated buffer shall be maintained between project construction activities and bald eagle or osprey nests during the nesting season (March 15 to July 31), and a 200-metre vegetated buffer shall be maintained during the remainder of the year. The 200 metre buffer also applies to all other raptor nests (e.g. Northern Goshawk, Sharp-shinned Hawk, Merlin, American Kestrel, Great-horned Owl, Boreal Owl, Northern Saw-whet Owl). The location of any raptor nest site must be reported to the Department of Fisheries and Land Resources by contacting (709) 637-2353.
  3. An environmental protection plan shall be submitted to the Minister of Municipal Affairs and Environment for approval prior to the commencement of project construction, which includes as a minimum, the following information:
    1. a management plan to minimize the risk of impacts to migratory bird nests, including a commitment to avoid the deposition of dredged material on a beach during the critical bird nesting season (April 15 to August 15) to prevent potential destruction of migratory bird nests;
    2. in the event that on-land disposal of dredged material occurs, a commitment to consult with a professional ornithologist or skilled birder to ensure that there are no nests or fledglings of migratory birds in areas where dredged material would be deposited;
    3. measures that will be implemented to prevent the spread of invasive species into and out of the bay during project construction;
    4. measures that will be implemented to minimize and control the release or re-suspension of sediments or contaminants resulting from in-water activities during construction, including but not limited to:
      • scheduling work to avoid heavy precipitation;
      • immediately stabilizing any disturbed areas along the shoreline to prevent erosion;
      • checking the integrity and effectiveness of the siltation control structures daily for the duration of the project and ensuring they remain in place following completion of the work until suspended solids levels return to ambient levels;
      • monitoring water quality to ensure total suspended solid levels and contaminant concentrations in the water column are within limits prescribed by the Canadian Council of Ministers of the Environment (CCME) Environmental Quality Guidelines for the protection of aquatic life when considered in conjunction with existing ambient water quality and site-specific factors (www.ccme.ca/publications/ceqg_rcqe.html); and
      • taking further mitigative actions as necessary based on monitoring results.

Point au Gaul Breakwater Upgrades (Reg.1989)
Proponent: Town of Point au Gaul

The project is released subject to the following condition:

An environmental protection plan for the project shall be submitted to and approved by the Minister of Municipal Affairs and Environment prior to the commencement of project construction, which includes as a minimum, a description of the following information:

  1. measures that will be undertaken to mitigate adverse environmental effects during construction, such as erosion, sedimentation, and/or the re-suspension of sediments or contaminants, to ensure compliance with the Canadian Environmental Quality Guidelines for the Protection of Aquatic Life;
  2. water quality monitoring that will be conducted to ensure total suspended solid levels and contaminant concentrations in the water column are within limits prescribed by the CCME Environmental Quality Guidelines for the Protection of Aquatic life;
  3. measures that will be undertaken to prevent the spread of aquatic invasive species, such as the European Green Crab, into and/or out of the bay;
  4. consultation that will be undertaken with DFO to determine whether the Point au Gaul shoreline is a capelin spawning area, and if so, measures will be implemented to mitigate habitat destruction; and
  5. a commitment to have a spill kit, equipped with an appropriate boom to prevent the spread of potential spills, on-site during project construction.
