Office of the Information and Privacy Commissioner - Report A-2017-019 Released

The Information and Privacy Commissioner, Donovan Molloy, has released his Report A-2017-019 under authority of the Access to Information and Protection of Privacy Act, 2015. A summary of the Report is included below.

To view the Report in its entirety, go to ATIPPA Access Reports at: //www.oipc.nl.ca/reports/commissioner

Summary: The Royal Newfoundland Constabulary (“RNC”) received an access request seeking disclosure of specific information related to a motor vehicle accident. The RNC denied access to the records based on section 31(2)(b) (disclosure harmful to law enforcement) of the ATIPPA, 2015. The Applicant was not satisfied with the RNC’s response and filed a complaint with this Office. During the complaint process, the RNC further claimed that the Highway Traffic Act exempted the records from the application of the ATIPPA, 2015. The Commissioner determined that only the Vehicle Collision Report was excluded and that the RNC applied section 31(2)(b) too broadly in withholding the RNC records created in addition to the Vehicle Collision Report. The Commissioner recommended that the majority of the information in the RNC’s records be disclosed, with some exceptions.
