OHS Charges Arise from Fatal Fall

Two companies and two individuals have been charged with violations of the Occupational Health and Safety Act and Regulations. The charges arise from an incident that occurred on October 25, 2013, involving an employee who suffered fatal injuries as a result of a fall from the roof of the building on which he was working in Labrador City. The charges are the result of an investigation by the Occupational Health and Safety Branch of Service NL.

The victim's employer was McCarthy's Roofing Limited, and the building owner was Northern Property REIT. The employer has been charged with eight counts that allege generally that:

  • it did not provide effective instruction and supervision;
  • a hoist was operated contrary to the manufacturer's specifications;
  • safe work procedures were not followed; and
  • a fall protection system was not provided.

Northern Property was charged with failing as a principal contractor to ensure that employers and workers complied with the Act and Regulations.

A McCarthy's Roofing Limited supervisor was charged with three counts generally alleging inadequate supervision. In addition, a worker of McCarthy's Roofing Limited was charged with four counts that allege generally that he did not take sufficient care to protect himself and other workers at the workplace.

The first appearance for all four is scheduled for November 26, 2015 at provincial court in Wabush.
