Company Facing OHS Charges in Provincial Court

Service NL announced today that Eastern Roof and Floor Truss Manufacturing (2008) Inc. and a company supervisor have been charged with violations under the Occupational Health and Safety Act and Regulations in relation to an incident that occurred in September 2011.  The charges are the result of an investigation by the Occupational Health and Safety Division.
 
The incident occurred on the Bonavista Highway, and involved a bicyclist who was struck by an overhanging truss which had been loaded onto the trailer of a delivery truck. The truck was en route to a worksite in Clarenville at the time. The victim suffered fatal injuries.
 
The company has been charged with a single violation under the Occupational Health and Safety Act which relates to its alleged failure as an employer to protect those not in its employ. A company supervisor was charged with knowingly permitting a worker to operate mobile equipment which could create an undue hazard to the health or safety of a person.
 
The first appearance for both is scheduled for September 19, 2013 at Provincial Court in Clarenville.
