Office of the Information and Privacy Commissioner – Report A-2017-002 Released

The Information and Privacy Commissioner, Donovan Molloy, has released his Report A-2017-002 under authority of the Access to Information and Protection of Privacy Act. A summary of the Report is included below.

Summary: The Applicant requested from the City of St. John’s a list of properties with arrears of municipal taxes, water taxes and/or interest exceeding $10,000. The City withheld the information on the basis that it would disclose information gathered for the purpose of collecting a tax as set out in sections 39(2) and 40(4)(d) of the Access to Information and Protection of Privacy Act, 2015. With respect to section 39(2), the Commissioner found that section 39(2) applied to part of the record and recommended that the name and address fields continue to be withheld. The Commissioner recommended that the amount of tax arrears and tax years for the amounts owing be disclosed.
