Environmental Assessment Bulletin

The Honourable Perry Trimper, Minister of Environment and Climate Change, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.

UNDERTAKINGS RELEASED:

Fermeuse Offshore Marine Base (Reg. 1773)
Proponent: Fermeuse Enterprises Ltd.

The project is released subject to the following conditions:

  • Fermeuse Enterprises Limited (FEL) shall prepare and submit an environmental protection plan (EPP) for all applicable construction and operation activities to the Minister of Environment and Climate Change. In addition to the information included in the EPP Table of Contents provided in Table 5 of Addendum 1, the EPP shall contain an Avifauna Management Plan, a Waste Management Plan and a description of fish, invertebrates, and marine mammals that may be present in the Fermeuse Harbour and Lumley Cove area year-round, and particularly during the planned construction periods. The EPP must be approved by the Minister prior to the start of any site specific construction.
  • The EPP referred to in paragraph (a) shall describe the environmental protection and mitigation measures that will be applied throughout the life of the Fermeuse Offshore Marine Base project to avoid or minimize potential negative effects on the biophysical and socio-economic environment associated with the project.
  • FEL shall adhere to all mitigation, monitoring and follow-up commitments made by the proponent in the EPR submitted on September 16, 2015, in the Addendum submitted on March 22, 2016, and in the second Addendum submitted on November 16, 2016.
  • FEL shall submit scheduled reports and partake in continued consultation with respect to employment and hiring practices, as required by the Department of Advanced Education, Skills and Labour and the Women�s Policy Office.

Main River ATV Trail (Keough�s Brook) (Reg. 1866)
Proponent: Arluk Outfitter�s Ltd.

The project is released subject to the following conditions:

  • Trail construction must not occur between April 1 to August 15 to avoid disturbance to Newfoundland Marten nesting, breeding and brood rearing; Newfoundland Caribou calving and post-calving; and migratory bird nesting, breeding and brood rearing.
  • A minimum 30-metre naturally vegetated buffer must be maintained along all water bodies except where crossing is permitted.

Bean Hill ATV Trail (Reg. 1867)
Proponent: Arluk Outfitter�s Ltd.

The project is released subject to the following conditions:

  • Trail construction must not occur between April 1 to August 15 to avoid disturbance to Newfoundland Marten nesting, breeding and brood rearing; Newfoundland Caribou calving and post-calving; and migratory bird nesting, breeding and brood rearing.
  • A minimum 30-metre naturally vegetated buffer must be maintained along all water bodies except where crossing is permitted.

Owl Head ATV Trail (Reg. 1868)
Proponent: Arluk Outfitter's Ltd.

The project is released subject to the following conditions:

The project is released subject to the following condition:

  • A Gender Equity and Diversity Plan must be submitted to and approved by the Women�s Policy Office prior to the start of the project.

ENVIRONMENTAL ASSESSMENT COMMITTEE APPOINTED:

Embree Residential Subdivision (Reg. 1858)
Proponent: David Nippard

On December 14, 2016, the minister advised the proponent that an environmental preview report (EPR) is required for this project. An environmental assessment committee (EAC) has now been appointed to provide scientific and technical advice to the minister and to prepare draft guidelines for conducting the EPR. The EAC has representation from the following provincial government agencies:

Proponent: Anaconda Mining Inc.

The Department of Environment and Climate Change and the proponent have agreed to extend the deadline for the minister�s decision to January 30, 2017.

Come by Chance Bulk Storage Tank Expansion (Reg. 1872)
Proponent: Asphalt Product Industries Inc.

The Department of Environment and Climate Change and the proponent have agreed to extend the deadline for the minister�s decision to January 22, 2017.

Argentia Access Road Industrial Composting Facility Project (Reg. 1838)
Proponent: Metro Environmental Services Incorporated

The Department of Environment and Climate Change and the proponent have agreed to extend the deadline for the minister�s decision to January 31, 2017.

Southern Labrador Waste Disposal Facility (Reg. 1848)
Proponent: Labrador Straits Waste Disposal Incorporated

The Department of Environment and Climate Change and the proponent have agreed to extend the deadline for the minister�s decision to February 28, 2017.
