Office of the Information and Privacy Commissioner - Report A-2016-018 Released

The Information and Privacy Commissioner, Donovan Molloy, Q.C., has released his Report A-2016-018 under authority of the Access to Information and Protection of Privacy Act. A summary of the Report is included below.

To view the Report in its entirety, please go to www.oipc.nl.ca/reports/commissioner

Summary: The applicant made a request to Central Health for records relating to an ongoing dispute. Central Health provided a large number of records, but withheld much information relying on section 30 (legal advice), section 32 (confidential evaluations) and section 40 (disclosures harmful to personal privacy). The applicant filed a complaint with this office. During informal resolution Central Health agreed to release most of the previously withheld information, and our office agreed that the remainder was properly withheld. However, this file was not resolved within the statutory time required by the Act. As Central Health has disclosed to the applicant all records recommended by this office during informal resolution discussions, the Commissioner recommended that Central Health continue to withhold the information withheld from the records last sent to the applicant.
