The Office of the Information and Privacy Commissioner has released Reports A-2016-011; A-2016-012; A-2016-013; A-2016-014; A-2016-015 under authority of the Access to Information and Protection of Privacy Act (2015). A summary of these Reports is included below.

An Applicant filed separate access to information requests to Eastern Health, Central Health, Western Health, Labrador Grenfell Health, and the English School District, requesting the name, job title and taxable income for the tax year 2015 for all employees who earned more than $100,000. Each public body sent all employees affected by the requests a third party notice in accordance with section 19(5). A number of those employees filed third party complaints with this Office in accordance with section 42(3), requesting that their personal information not be released to the Applicant.

As a result of these complaints, the Commissioner conducted investigations and issued five very similar individual reports, one in relation to each public body, with identical findings and recommendations. The Commissioner found that section 40(2)(f) applied to the requested information, and as a result the Commissioner determined that the disclosure of the requested information is deemed not to be an unreasonable invasion of the personal privacy of the employees. The Commissioner recommended release of the requested information.
