Auto Shop Sentenced for Occupational Health and Safety Violations

The Department of Government Services announced today that ERL Enterprises Limited was sentenced in St. John’s Provincial Court upon pleading guilty to two violations under the Occupational Health and Safety Act. Three charges were laid in July of this year.

The incident occurred in September 2010 at the auto repair shop premises on Blackmarsh Road in St. John’s and involved a worker who was pinned beneath a vehicle which was being repaired. The worker suffered serious injuries to his back and ribs.

The company pled guilty to the charge of failing to provide the information, instruction, training, supervision and facilities necessary to ensure the safety of workers, and to the charge of failing to ensure that safe work procedures are followed at the workplace. The company was fined $3,000 for each violation, and a victim fine surcharge was imposed. The remaining charge against the company was withdrawn.

A further charge to a supervisor with ERL Enterprises has been set over to November 2. The supervisor was charged with an alleged failure to provide proper oral or written instructions regarding the precautions necessary to protect workers.
