Company Sentenced for Occupational Health and Safety Violations in St. John’s Provincial Court

The Department of Government Services announced today that Kelloway Construction Limited was sentenced in St. John’s Provincial Court upon pleading guilty to two violations under the Occupational Health and Safety Act. Six charges were laid in February of this year.

The charges resulted from an investigation carried out by the Occupational Health and Safety Branch into activities which occurred between April and September 2009 at the demolition site of the former Janeway Hospital in St. John’s.

The company pled guilty to the charge of failing to take all necessary measures to ensure that the exposure of employees to airborne asbestos is reduced to the lowest practical level, and to the charge of failing to ensure that appropriate measures were taken to prevent pollution of the general environment by asbestos dust released from the workplace.

The court order requires the company to pay fines of $10,000. In addition the company is ordered to pay $3,000 to the Department of Government Services for the purpose of public education in occupational health and safety. The remaining four charges against the company were withdrawn.
