Town of Massey Drive Faces OHS Charges in Provincial Court

The Department of Government Services announced today that the Town of Massey Drive has been charged with violations under the Occupational Health and Safety Act and Regulations in relation to an incident that occurred in August 2008.

A worker for the town was situated inside a trench when one wall of the trench gave way, partially burying the worker. The man sustained injuries to his back and shoulder and was admitted to Western Memorial Regional Hospital. The charges are the result of an investigation by the Occupational Health and Safety Branch.

The town has been charged with four violations under the Occupational Health and Safety Act and Regulations which relate to its failure as an employer to ensure that workers inside a trench are effectively protected, excavated material is positioned at a safe distance from the trench, safety procedures are followed, and to provide the instruction and supervision that will ensure the health and safety of workers.

The town had a first appearance in court on April 6 and a second appearance is scheduled for May 11 at Provincial Court in Corner Brook.
