Public Body: College of the North Atlantic
Summary: The Applicant applied under the Access to Information and
Protection of Privacy Act (the "ATIPPA") for access to
records relating to his employment with the College of the North
Atlantic (the "College"). The College released some of the records
responsive to the Applicant�s request but denied access to information
contained in an e-mail exchange on the basis that it was subject to
solicitor-client privilege and, therefore, covered by the exception set
out in section 21(a). The Applicant argued that the information was not
subject to solicitor-client privilege and, furthermore, any
solicitor-client privilege that may have existed had been waived by the
actions of the College. The Commissioner determined that the information
in the e-mail exchange was subject to solicitor-client privilege and
that the College had not waived its right to claim solicitor-client
privilege. The Commissioner concluded that the College had met the onus
imposed upon it by section 64(1) and had proven that the Applicant had
no right of access to the information at issue.
