Company Sentenced on Violation of Occupational Health and Safety Act

The Department of Government Services announced today that Clarke�s Trucking and Excavating Ltd. was sentenced in Provincial Court on October 8, 2008, upon pleading guilty to one violation of the Occupational Health and Safety Act. Charges were laid in December 2007 as a result of an accident investigation carried out by the Occupational Health and Safety Branch.

The accident occurred at a site on Harding�s Road in St. John�s on December 19, 2005, and involved a worker who sustained a crush injury to his leg when struck by an excavator. The leg was subsequently surgically amputated.

The company pled guilty to the charge of "disturbing the scene of an accident that results in serious injury or death."

The plea agreement requires the company to pay a total of $12,500, comprising a $10,000 fine together with a $2,500 amount earmarked to the Minister of Government Services for the purpose of public education in the field of occupational health and safety. The remaining two charges against the company pertaining to failing to provide training and ensuring the wearing of protective clothing were withdrawn.
