Occupational Health and Safety Lays Charges Against Two Companies

The Department of Government Services announced today that two companies have been charged with alleged violations of the Occupational Health and Safety Act and Regulations. The charges against both companies arose from the same incident.

TJs Roofing Limited is alleged to have violated the legislation relating to fall protection while its workers were working on the roof of a housing construction project in St. Johns. ERCO Developments Inc., the project developer, is alleged to have failed in its duties as a principal contractor to ensure that the sub-contractor it hired complied with the Occupational Health and Safety Act governing fall protection. This incident, which occurred in December 2006, did not result in an accident. The first appearance for both companies is scheduled for July 8, 2008, at St. Johns Provincial Court.

The charges are the result of an investigation by the Occupational Health and Safety Branch of the Department of Government Services.
