Environmental Assessment Bulletin

The Honourable Charlene Johnson, Minister of Environment and Conservation, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.

UNDERTAKING WITHDRAWN:

Crown District 19A (Goose Bay) Five Year Forest Operating Plan (2008 -12)

Proponent: Department of Natural Resources (Reg. 1351)

The proponent withdrew the undertaking on June 11, 2008, and intends to resubmit the registration at a later date.

UNDERTAKINGS REGISTERED:

Marystown Marine Industrial Park Development (Reg. 1387)

Proponent: Town of Marystown

The project involves the development of a Marine Industrial Park, consisting of a 20 hectare site adjacent to Powers Cove on the west side of Mortier Bay. The development will include a 1.2km access road off McGettigan Boulevard, water, sewer and power lines. Commercial lot development will occur along the length of the access road, with space for approximately 15 one-hectare lots. The development is for the commercial/industrial sector, with a potential future marine access to meet a growing demand in the marine services sector.

The undertaking was registered on June 24, 2008; public comments are due by August 1, 2008; and the minister's decision is due by August 8, 2008.

Crown Forestry District 1 (Mushroom Gully) Amendment (Reg.  1388)

Proponent: Newfoundland Forest Services, Department of Natural Resources

The proponent proposes to cut two blocks of timber comprising a total area of 14.3 hectares with a soft wood volume of approximately 1,100 cubic metres. Commercial harvest area B-1C was scheduled for harvest from 2007-2009. Due to a conflict with the Endangered Species Act with respect to the arboreal lichen Erioderma pedicellatum, this area was withdrawn from the plan. As a consequence, a small commercial harvester who was scheduled to cut this area was without timber to harvest. The purpose of this amendment is to address this situation by providing the timber volume required by this operator over the next two to three years. The two proposed harvest blocks are residual stands that were not harvested in the previous five year plan. These stands are located on the Clam River Forest Access Road (Fox Marsh area) which is scheduled for decommissioning in this five year plan. No roads will be constructed prior to or as part of this harvesting activity.

The undertaking was registered on June 24, 2008; public comments are due by August 1, 2008; and the minister's decision is due by August 8, 2008.

Comments on submitted documents are invited from the public, addressed in writing to the minister, and are welcome prior to the deadline date shown.

ENVIRONMENTAL PREVIEW REPORT REQUIRED:

Portland Creek Agricultural Land Development   (Reg. 1365)

Proponent: Brophy Dairy Farms Ltd.

The minister has advised the proponent that an Environmental Preview Report (EPR) is

required for this project. An Environmental Assessment Committee will be appointed to provide advice to the minister on the Guidelines and EPR.

ENVIRONMENTAL IMPACT STATEMENT ACCEPTED:

Long Harbour Commercial Nickel Processing Plant (Reg.  1243)

Proponent: Vale Inco Newfoundland & Labrador Limited

A review has been completed of the Environmental Impact Statement (EIS) as revised for this proposed undertaking. This re-submitted EIS complies with Part X of the Environmental Protection Act (the Act) and the Guidelines of 2006 10 31 for this Project, and requires no further work. The minister will now be recommending to the Lieutenant-Governor in Council whether or not this project should be refused or can now be released per Section 56 of the act subject to terms and conditions.

A federal screening of the project under the Canadian Environmental Assessment Act is continuing under the lead of the Department of Fisheries and Oceans and Transport Canada.
