Office of the Information and Privacy Commissioner November 7, 2007 Report 2007-016 Released The Information and Privacy Commissioner, Phil Wall, has released his Report 2007-016 under authority of the Access to Information and Protection of Privacy Act. A summary of the Report is included below. To view the Report in its entirety, please go to //www.oipc.gov.nl.ca/reports.htm Report: 2007-016 Summary: The Applicant applied to the College of the North Atlantic ("CNA") for access to certain records. CNA responded by saying that the requested records do not exist. The Applicant asked the Commissioner to review CNAs decision. The Applicant presented evidence which he believed must point to the existence of the records. CNA disagreed, stating that such a conclusion on the Applicants part was merely a supposition, and that it had conducted a thorough and reasonable search for the records. The Commissioner accepted that a reasonable search had been conducted, and was not convinced that the Applicants submission formed a basis to conclude that responsive records may exist. As a result, no recommendation was issued by the Commissioner in this Review. -30- Media contact: Sandy Hounsell
