Changes to Mandatory Retirement Rules Effective May 26

Changes to the provincial Human Rights Code affecting mandatory retirement will be effective May 26, 2007 and businesses should ensure the necessary steps are taken to inform employees of their right to work beyond the age of 65.

"It is vital employers and employees are advised of their rights and the enhanced protection under the changes to the Human Rights Code," said Minister of Justice, the Honourable Tom Osborne. "We want to remind employers they may need to adjust their employment policies and programs in response to these changes which were passed in the House of Assembly last May."

The Human Rights Code now allows employees to decide to retire based on lifestyle, circumstances and priorities, and does not force retirement based on age restrictions.

In all Canadian jurisdictions the code still allows exceptions for a A good faith occupational qualification." For example, in some provinces school bus drivers may have to retire at age 65 or in other regions police officers may have to retire at age 60, or take a test to prove their fitness.

The Human Rights Code amendments were passed in the House of Assembly in May 2006, allowing employers and other stakeholders a year to prepare for any changes needed.

More information on mandatory retirement will be mailed to employers across the province this month informing them of the changes. Additional information can be obtained by visiting the Department of Justice Website at www.justice.gov.nl.ca or by calling 1-709-729-2889.
