Stephenville Company Sentenced in Provincial Court

The Department of Government Services announced today that 10503 Newfoundland Limited, trading as Callahan�s Contracting, was sentenced in Stephenville Provincial Court on March 12, 2007 upon pleading guilty to one violation of the Asbestos Abatement Regulations. Charges were laid in June 2006 as a result of an investigation carried out by the Occupational Health and Safety Division. Arising from the same incident, one charge was also laid against an individual who was hired by the company to undertake asbestos abatement.

The incident was an alleged potential exposure to asbestos which occurred at a building renovation site in Stephenville on June 23, 2004.

The regulatory section requires that materials suspected of containing asbestos must be handled as such, until analysis by a competent laboratory determines whether or not the materials actually contain asbestos. In pleading guilty to this charge, the company admitted its failure to handle the materials properly on the day in question.

The company was fined $2,000 on the charge, in addition to an assessment of a victim fine surcharge of $300. The remaining three charges against the company were withdrawn, as was the single charge against the individual.
