Office of the Chief Electoral Officer February 15, 2007 Official Count Humber Valley By-election Charles Furey, the Chief Electoral Officer, has announced the results of the official count of ballots in the February 12 by-election in the District of Humber Valley. As required by Section 153 (1) of the Elections Act, the official addition of the votes took place this morning at the office of the district returning officer in Deer Lake. As a result, the official count is:
Six ballots were rejected. Six ballots were cancelled. Therefore, under section 156 of the Elections Act, Dwight Ball is declared elected in the District of Humber Valley. Mr. Furey points out that the same section of the Act also requires that in any election where ten votes or fewer separate the elected candidate from the candidate with the next largest number of votes, the Chief Electoral Officer must apply to the courts for a judicial recount. The law requires that this application to the court for a recount be made within 7 days. Mr. Furey says he has instructed his legal staff to make this application immediately.
