ON CONSERVATION OFFICERS IN NEWFOUNDLAND and LABRADOR

This archive was been compiled in November 2001. Therefore, it is not a complete list but is a good representation of the types of situations that conservation officers encounter in this province.

3 Intoxicated hunters

11 p.m. on a Sunday night, the officer encountered the individuals hunting big game. While officer attempted to seize the gun, death threats were issued against him and a wrestling match took place. Punches were exchanged. Officer and violator held the gun and a second individual jumped on the officer's back and held him in a choke-hold. Officer broke free and retreated but sustained a deep gash and a bloodstained shirt. All three were later charged and convicted.

Fishing Rod

2 Males

Stakeout and takedown of illegal netting of Atlantic salmon in inland waters resulted in an officer being struck in the head with rod and reel and kicked several times after being knocked to the ground. Suspect was apprehended and charges laid for assaulting a peace officer. Suspect fined and imprisoned.

1988-01

303 Rifle

1 Male Hunter

Officers encountered individual hunting big game out of season. Individual loaded rifle and shouted, "Stay away from me." He turned to run away, then turned back and fired at officers. He reloaded and in a state of panic pointed the rifle at officers and repeated, "Stay away from me." Officers retreated. The individual was charged and received $1000 fine, was prohibited for five years from hunting big game and received one year in jail plus probation for assaulting the officers.

2 Males (One intoxicated)

Officers and a fisheries guardian while performing boat patrol checked a lone duck hunter in an open boat which had just docked. Upon inspection of the boat, the firearm was found to be unplugged. While seizing the firearm and migratory birds, a relative came on the scene, became very belligerent, and threatened to shoot the officers and sink their boat. Charges laid against relative for uttering threats to cause death.

Officer was obstructed from conducting a routine inspection of a firearm belonging to a known poacher. A struggle for the firearm ensued and the officer was successful in gaining control. The suspect then attacked the officer, resulting in officer drawing his pepper spray and stopping the attack. Charges laid and a conviction was secured.

1 Male Hunter

Officer was conducting uniformed snowmobile patrol when he encountered a ptarmigan hunter who upon realizing that the officer was stopped in the trail, increased his speed and struck him in the leg with his snowmobile. He then collided into the officer's machine and continued on almost colliding with a marked patrol vehicle. The officer caught up to the man who again rammed him with his snowmobile and sped off. He was later arrested and charged with obstruction and assault. (Violator was in possession of a firearm but it was not drawn).

3 Males

While responding to a complaint of three individuals poaching big game, an officer encountered them on two snowmobiles. The suspects deliberately collided with the officer knocking him to the ground. All three were charged with obstruction.

1996

 

1 Male

Officer was involved in an investigation of a male suspect during which the suspect threatened to kill the officer, along with his wife and two children, and to burn down his house. He also threatened to shoot the officer on sight if he ever met him in the woods. Charges laid along with RCMP criminal code charges. Suspect received 1.5 years in jail.

 

 

Rifle

1 Male

1 a.m. Officers encountered two vehicles suspected in illegally night hunting for big game. The suspect refused to stop to emergency lights and a short pursuit occurred. The violator became very agitated and, while he did not use it, he was in possession of a high-powered rifle during the incident.

 

 

 

1 Male Intoxicated

3:30 a.m. the violator, with two illegally taken moose in the back of his pickup, refused to stop to officer's emergency lights. Once stopped, the violator became very abusive and uttered all manner of threats . The result was a scuffle with the violator in the ditch. He was put in hand cuffs and taken to the lockup. The moose and truck were seized.

1 Male

Officer checked a rabbit hunter and found that he didn't have a licence. While officer attempted to seize the small game and axe, the violator threatened to chop up the officer with the axe and refused to turn over the axe and game. Violator received three days in Waterford and a month in jail.

1 Male Intoxicated

Officer checked suspect and found caribou blood and hair on the person. Shortly after the officer found the kill site and seized a snowmobile. Suspect then threatened to kill the officer with an axe. Charged, found guilty and fined $750 for the assault.

 

Chainsaw

1 Male

Officer threatened to be dismembered with a chain saw by a woodcutter. Individual charged with threatening a peace officer.

2 Males

Officer investigating illegal hunting of migratory birds. Suspects bolted into nearby woods and upon the officer's approach, they discharged a weapon and upon arrest refused to relinquish game. Charged with obstruction.

1 Male

Officer found suspect in possession of a firearm without a licence. An attempt to seize the firearm was made. Suspect refused to relinquish the firearm. Charged with obstruction.

3 Males

Officers snowmobiled to a snowmobile parts store where they were told by the three individuals that if they saw them in the woods they would shoot the officers. Individuals left without incident.

1986-12

 

Several persons in automobile

Officers were approached and threatened with death if they did not leave. The vehicle drove off with no other incident.

1994-10

Rifle

1 Male

1 Female

Officers seized a rifle from an individual in a closed area. Shortly afterwards the male, accompanied by the woman, came to their camp and demanded the firearm back and proceeded to the patrol vehicle to retrieve the rifle. When the officer stepped between the woman and the truck preventing her from opening the door, she pushed the officer against the door and uttered threats. As they were leaving, the male told the officers that they would return with 30 others and there was going to be trouble. The woman was charged with physical assault, uttering threats and obstruction and she received two weeks in jail.

Officers checked the nine persons who were staying in the department's patrol camp without authorization. Their names were recorded and they were asked to leave. They agreed after a heated discussion. One kilometre down the road, the nine approached the officers in two pickups - one parked behind the patrol vehicle, the other in front. Nine of them then surrounded the patrol vehicle and the officers were ordered to hand over the pages from their notebooks. Officer managed to get his truck around the parked vehicles. The nine jumped in their trucks and gave chase after the officers who lost them after 15 minutes. One individual was charged with obstruction and uttering threats.

2001-09

 

1 Known Offender

A known individual phoned the department's office and told one officer that another officer would have to watch his back in the woods because he would do him harm. He also threatened to burn down the department's patrol cabin.

Uttered threats of death after fined rendered at provincial court.

2001-06

 

Known Poaching Ring

Verbal threat delivered to conservation officer that if he was seen in a certain area he would be shot, his body placed in the bog and his patrol vehicle driven into the lake.

1997-02

 

1 Male

The individual uttered threat to do bodily harm while the officer was performing an investigation at a resident's shed. The suspected activity was hunting small game out of season. The incident reported to RCMP.

1 Male

Officer checked hunter who was hunting migratory birds out of the season. The individual refused the officer's request to turn over his firearm. Officer did not engage in physical confrontation.

1993-01

Axe

1 Male

While officers were executing a search warrant, one officer was in the process of seizing a snowmobile when suspect told him he was going into the house to get an axe and neither officer would leave alive. The suspect then went into the house where he was arrested and placed in hand cuffs.

1991-11

 

2 Males

Officer patrolling alone late at night attempted to stop a suspected night hunter. A chase pursued and ended at a dead-end road. Suspects exited their vehicle and attacked the officer. He responded by drawing his baton and attempting to deliver a strike. Both individuals were charged with obstruction and convicted.

While responding to complaints, an officer came into contact with two individuals on the wetlands who were hunting for small game. When the two were informed they were going to be charged they became upset and threats were issued to do bodily harm to the officer. One male removed some clothing in preparation to fight with the officer. More threats were issued by the individuals and the situation became very tense. A shotgun was drawn from the ATV and threats to shoot the officer were issued. Officer withdrew and contacted RCMP. Charges were laid and convictions rendered.

 

 

 

 

 

Officer's patrol vehicle was sabotaged in order to cause an accident. Officer had received threats in the past. Investigation launched by RCMP.

Chainsaw

1 Male

Officers were seizing a chainsaw as evidence during a ongoing investigation. One officer was violently pushed and the chainsaw yanked from his hands. The individual, in a very agitated state refused to relinquish the saw, his actions and demeanor concerned the officers. The RCMP was called to assist and charges were laid.

Shotgun

1 Male

Officer observed duck hunter coming up from a point that is well-known for taking inland duck. Being that it was closed time for inland birds, the officer proceeded to check the hunter. It was dusk when the officer met the hunter and asked him to stop. The hunter raised his shotgun at the officer who was approximately 40 feet away. The officer told the hunter not to shoot him - a few seconds went by and the hunter still had the shotgun trained on the officer. Again the officer shouted at the hunter not to shoot him and with this request the hunter complied. The officer obtained the gun and ejected three shells from the weapon, The officer asked the hunter what his problem was and why he would not lower the gun the hunter replied he thought a bear was after him and he went into shock when the officer yelled at him. The hunter was charged and convicted.

Wood cutter threatened physical assault over non-issuance of a wood cutting permit.

1 Male

Threat was made to an MHA's office by a violator after wood had been seized and charges laid by conservation officers. He stated that he was going into the local forestry office with a gun. The RCMP was notified and the forestry office was closed. Individual was arrested, charged and convicted.

Officer physically restrained followed by a wrestling match. Officer freed himself and followed through with seizing evidence to lay charge. One male charged with obstructing a peace officer.

2001-11

2 Rifles

2 Males

Officer attempted to check two hunters carrying rifles; however, the individuals ran from officer. Officer gave pursuit and caught up to the individuals. When officer asked the men to put the rifles on the ground they would not comply. Officer reached for pepper spray and received compliance.

2001-04

 

15-18 People

An officer was barricaded on a wharf after he observed individuals on the water hunting ducks. Officer was held until violators could get away.

Officer seized firearm from violator who then uttered threats to cause death.

1 Male

Uttered threats of death after a fine was rendered at a courthouse.

1997-10

Chainsaw

1 Male

1 Female

Officer checked cutters at roadside. Upon approach, the male swung a chainsaw at the officer missing his face by inches. The saw was still going as he continued to swing it at the officer as he tried to back away. The male then uttered to cut the officer in two if he came back. The RCMP was called and the man arrested.

2001-11

Firearm

3 Males

Officer, while on down time, happened upon three males who he knew. While engaged in a brief conversation, the officer viewed a rifle in the possession of the passenger in the rear seat. Officer then decided that he would check the hunters. While the officer was conducting the inspection, the three individuals turned on the officer, physically assaulted him and issued threats of death. The officer managed to strike two assailants and make his escape. The RCMP was called and all three arrested.

2001

 

1 Male Intoxicated

Officer was approached by an individual who was drunk and fairly belligerent. He stated that if he ever met the officer in the woods, that he would have no second thoughts about shooting the officer, and he also stated that no one would ever know.

Verbal threat to do serious bodily harm by cutting officer in two with his chainsaw.
