The following is being distributed at the request of the Human Rights Commission:

The Human Rights Commission reports that a board of inquiry will commence on Monday, February 17, 2003, to hear the complaints of Anna Haby, Theresa Quilty and Betty Stacey.

The three women filed complaints with the Human Rights Commission alleging that the Department of Labour and the Workplace, Health, Safety and Compensation Commission (WHSCC) discriminated against them on the basis of marital status when government passed, and the WHSCC administered, a May 2001 amendment to the Workplace, Health, Safety and Compensation Act. The amendment states "a person whose monthly allowance as a surviving dependent spouse was terminated on or after April 17, 1985 due to his or her remarriage is entitled to receive the compensation that he/she would have received had the monthly allowance not been terminated."

All three women had remarried prior to April 17, 1985 and therefore were not entitled to the retroactive compensation as contemplated by the amendment. They allege that their exclusion from eligibility for the retroactive payment constitutes discrimination on the basis of martial status.

The hearing into this complaint, which is open to the public, is scheduled to commence at 10:00 a.m. on Monday, February 17 at the Labour Relations Hearing Room, 5th Floor, Beothuck Building, 20 Crosbie Place, St. John�s. Judy Morrow, a solicitor from Bay Roberts, has been assigned to hear the matter.
