The Human Rights Commission is pleased to release the decision of Adjudicator Mary O�Brien upholding the complaint of Shelly House-Borden against Corner Taxi Ltd. and William Mercer Sr.

Shelly House-Borden of Corner Brook filed a complaint with the Commission in November 2000 alleging sexual harassment. In her complaint, Ms. House-Borden stated that both she and her husband were fired by Mr. Mercer Sr. after she filed a sexual assault charge against him. In her complaint, Ms. House-Borden stated that she had been in an employment relationship with the respondents for approximately three years when she was subjected to the sexual harassment.

The complaint could not be settled during the investigation and in June 2001, the Human Rights Commission ordered the appointment of a Board of Inquiry.

Adjudicator Mary O�Brien heard the complaint in Corner Brook in February 2002. In her decision dated October 16, 2002, Adjudicator O�Brien found both respondents to be jointly liable to the complainant. She ordered that Ms. House-Borden be compensated in the amount of $2,000 for general damages. Ms. House-Borden was not seeking lost wages.

Ms. House-Borden�s complaint was presented to Adjudicator Mary O�Brien by Jeff Cutler on behalf of the Human Rights Commission. Copies of the decision are available at the office of the Human Rights Commission.
