NLIS 4 October 6, 2000 (Justice) Crown to appeal Bradbury decision The Crown will appeal the amount of damages awarded in the September 28, 2000 Newfoundland Supreme Court decision, ordering the provincial government to pay former employee Kenneth Bradbury for damages resulting from the loss of his job in 1991. The Bradbury case is unique and unlike other cases involving public service employees, where damages being sought are for enhanced redundancy packages. Bradbury�s claim arose from errors made by the Public Service Commission in administering the re-employment priority policy in his case. It is the Crown�s view that the judge erred in the Bradbury matter, by failing to recognize the various factors that must be considered when determining the amount of damages in such cases.
