On Friday, December 5, 1997, the Director of Child Welfare, on behalf of Jamie Batten, filed a statement of claim in the Supreme Court of Newfoundland, Trial Division. The statement names the Health Care Corporation of St. John's and the attending physicians at the Janeway Child Health Centre as being negligent in the diagnosis and treatment of Jamie Batten between December of 1995 and August of 1996.

Jamie Batten is currently in the interim care and custody of the Director of Child Welfare. This action is being taken at this time to protect the legal right of Jamie to sue. Legal action against hospitals and medical professionals usually has to be taken within two years of treatment. Given the issue of limitation periods and the fact that Jamie's initial contact with the Janeway Health Centre took place in December of 1995, the director felt it was appropriate and in Jamie's best interest, to file this statement now.

Jamie's rights and interests are paramount in the Director of Child Welfare's decision to take this action.
